ACCIDENTAL DAMAGE WAIVER All reservations include a $30.00 nonrefundable damage waiver fee, which covers up to $300.00 of accidental damage to the rental property during your occupation. If you are renting multiple units, a damage waiver fee is charged for each unit. This fee eliminates the need for the traditional security deposit protecting you and the home owner in the event of accidental damage during the rental period. The guest has paid an Accidental Damage Waiver (ADW) fee to the Company (shown on Rental Agreement) prior to arrival. The guest agrees that the Party Leader remains responsible for all damage during the rental period. The Registration Form must be completed and returned with the Rental Agreement upon reserving a home. A valid credit card number is also required to be kept on file in addition to the ADW fee. The Accidental Damage Waiver is limited to a maximum of $300 per stay. Damage in excess of this maximum and negligent or intentional damage will be the responsibility of the guest. The company reserves the right to determine levels of damage and the presence of negligent versus accidental damage. Damages must be reported at the time of incident to be covered under the ADW. The Accidental Damage Waiver will be void if the guest fails to report the damage, and the guest will be responsible for the cost of repairs and/or replacements. Damages not covered by the ADW will also be charged to the renter. Where loss or damage to the property, the inventory or equipment exceeds $300, the Company will bill the Guest for the shortfall, and the Guest agrees to pay within 14 days. Should the guest fail to pay any such shortfall the Company reserves the right to exercise any legal remedies to pursue the amount owed from the guest. Where damage or loss to a property is found following the departure of a guest that in the view of the Company constitutes malicious or wanton damage the company reserves the right to notify law enforcement authorities and prosecute, in addition to billing the Guest for the full amount of repair or replacement, and the guest agrees to pay within 14 days. Damage Waiver Fee does NOT cover: The Kissimmee Rental Company; Property Management Company or the Homeowner are not responsible for the damage, loss or theft of personal property, including but not limited to automobiles, motorcycles, recreational vehicles, personal items and cash. DAMAGE: Guests must report any breakage or damages to us upon occurrence, prior to check out and settle the matter prior to leaving. If there is any damage to the Rental Property or its furnishings, the Guest does agree to be responsible for the cost to repair any damages (not covered by ADW) done by either the Guest or a member of the Guests party. All Rental Properties are inspected after each Guest leaves by a property manager any problems found are reported to the Company for appropriate billing if necessary. Damage Waiver Effective Term
